AGB

Your Terms and Conditions (AGB) section constitutes a legally binding contract between you and your customers. You provide your customers with information and services, and your customers must adhere to your rules.

Typical provisions in the Terms and Conditions allow you to:

  1. Withdraw or cancel services and perform financial transactions.
  2. Manage customer expectations, such as liability for inaccurate information or website downtimes.
  3. Explain rules related to copyright, such as attribution, adaptation, commercial and non-commercial use, etc.
  4. Establish rules for user behavior, such as prohibiting illegal activities, hate speech, bullying, promotions, spam, etc.
  5. Disable user accounts.
  6. Formulate additional provisions aimed at protecting you or your target audience.

RETURN, SHIPPING, AND REFUND POLICY Prices, Shipping Costs

(1) The prices and shipping costs stated in the respective offers represent final prices. They include all price components, including all applicable taxes. If delivery is made to non-EU countries, additional customs duties, taxes, or fees may be payable by the customer, but not to the provider, rather to the customs or tax authorities responsible there. The customer is advised to inquire about the details from the customs or tax authorities before placing an order.

(2) Shipments that cannot be sent as parcels due to their nature or size are shipped by freight carrier.

(2.1) Delivery of a shipment by freight carrier is made to the "curbside" or behind the first lockable door. Deliveries to non-ground floor levels are excluded.

(2.2) Additional costs are incurred for freight deliveries abroad, which are individually calculated based on the size of the order and the destination country. These costs cannot be listed as part of the shipping costs at the time of order completion due to individual calculation. The provider may separately invoice these costs to the customer even after the actual order completion. If the customer does not wish to bear these costs, the customer may withdraw from the purchase agreement in this case.

(3) The applicable shipping costs for parcel shipments are not included in the purchase price. They can be accessed via the "Shipping and Payment Method" page, will be separately indicated during the ordering process, and are to be borne by the customer in addition, unless free shipping is promised.

Return Costs When Exercising the Right of Withdrawal

(1) In the event of the exercise of the statutory right of withdrawal for distance contracts applicable to consumers, it is agreed that the customer shall bear the regular costs of returning the goods.

(2) The return must be made in the original box + neutral, appropriate outer packaging. Affixing return labels to the original box is prohibited. If the return shipment is made without neutral, appropriate outer packaging, the provider will refuse acceptance of the return.

 

Right of retention, retention of title

(1) The customer may only exercise a right of retention to the extent that it relates to claims arising from the same contractual relationship.

(2) The goods remain the property of the provider until the full payment of the purchase price.

(3) If the customer is a business entity, the following additional provisions apply:

(3.1) The provider reserves the right of ownership of the goods until full settlement of all claims arising from the ongoing business relationship. Prior to the transfer of ownership of the goods subject to retention of title, pledging or transfer of ownership by way of security is not permitted.

(3.2) The customer may resell the goods in the ordinary course of business. In this case, the customer hereby assigns to the provider all claims in the amount of the invoice value arising from the resale. The customer is authorized to collect the assigned claims. However, if the customer fails to meet its payment obligations properly, the provider reserves the right to collect the claims themselves.

(3.3) In the event of the goods subject to retention of title being combined or mixed with other items, the provider acquires co-ownership of the new item in proportion to the invoice value of the goods subject to retention of title in relation to the other processed items at the time of processing.

(3.4) The provider undertakes to release the securities to which they are entitled upon request by the customer, to the extent that the realizable value of the provider's securities exceeds the secured claim by more than 10%. The selection of the securities to be released is at the discretion of the provider.

 

Warranty

(1) The legal regulations apply. (2) As a consumer, the customer is kindly requested to immediately check the goods upon delivery for completeness, obvious defects, and transport damage, and to notify the provider of any complaints as soon as possible, but no later than 2 working days after receiving the goods. (3) In the case of used items, the warranty period is one year from the delivery of the goods, deviating from the statutory provisions. The one-year warranty period does not apply to damages caused by the provider that can be attributed to culpable violations of life, body, or health, as well as damages caused by gross negligence or intent of the provider, and in cases of recourse claims according to §§ 478, 479 of the German Civil Code (BGB). (4) If the customer is an entrepreneur, the following deviations from paragraph 1 apply: (4.1) Only the provider's own information and the manufacturer's product description are deemed to be the agreed characteristics of the goods, not other advertisements, public statements, or statements made by the manufacturer. (4.2) The customer is obligated to immediately examine the goods for any deviations in quality and quantity with due care and to notify the provider in writing of any obvious defects within 2 days of receiving the goods; timely dispatch is sufficient to meet the deadline. This also applies to hidden defects discovered at a later date. If the obligation to inspect and give notice of defects is violated, the assertion of warranty claims is excluded. (4.3) In the case of defects, the provider provides warranty by either rectifying the defect or delivering a replacement. If the defect repair fails twice, the customer may, at their discretion, demand a reduction in price or withdraw from the contract. In the case of rectification, the provider is not required to bear the increased costs resulting from the transport of the goods to a location other than the place of performance, unless such transport does not correspond to the intended use of the goods. (4.4) The warranty period is one year from the delivery of the goods. The shortened warranty period does not apply to damages caused by the provider that can be attributed to culpable violations of life, body, or health, as well as damages caused by gross negligence or intent of the provider, and in cases of recourse claims according to §§ 478, 479 of the German Civil Code (BGB).
